Environmental Rights

The constitutional and public-law foundation for a safe, healthy and sustainable environment in Bangladesh.

CW Earth advances a simple public principle: environmental protection is a constitutional commitment and a necessary condition for the enjoyment of life, health, livelihood, dignity and a secure future.

The constitutional foundation

Article 18A of the Constitution of Bangladesh directs the State to protect and improve the environment and to preserve and safeguard natural resources, biodiversity, wetlands, forests and wildlife for present and future citizens. This commitment provides a constitutional standard against which public policy, administration and environmental governance can be examined.

Life, lawful treatment and environmental harm

The constitutional protections of life and lawful treatment are also relevant when pollution, ecological destruction or unsafe public action threatens people and communities. Environmental cases in Bangladesh have considered how serious environmental harm can engage the protection of life, public health, livelihood and lawful government action.
